Endura and M-D Settle Litigation Lawsuit

Endura Products, Inc., of Greensboro, N.C., and M-D Building Products Inc., of Oklahoma City, Okla., have announced that they have settled their patent litigation lawsuit.

Endura filed a Federal Court lawsuit in 2004 in order to enforce its United States patents pertaining to its Z-Series™ and Z-Plus™ Sills, as well as its ZSeries™ Job Site Sill Cover. Endura asserted that M-D's new SmartSill™/SmartTrack™ Ultra™ sills and paint covers infringed upon these patents.

Endura and M-D have reached an amicable resolution of the lawsuit. As part of the settlement, M-D has discontinued the designs about which Endura objected and has acknowledged the validity and enforceability of Endura's patents. M-D did not acknowledge that its designs infringed Endura's patents, but elected to change its designs in the spirit of cooperation and to avoid protracted litigation costs.
